Abstract

This Article offers an alternative to the standard assumptions concerning the interpretation of Free and Open Source Software licenses – that such licenses should not be seen as transactions in which parties negotiate towards a classic contractual “meeting of the minds”. Rather, such licenses should be interpreted as boilerplate arrangements applied by parties without negotiating the language of the agreement. The Article considers some of the consequences of this approach to license interpretation
